TERMS AND CONDITIONS
The following terms and conditions apply to all purchases of Green Training Works Ltd off-the-shelf video tapes, CDs, DVDs and related training materials made on or after 19 August 2008. The use of this site for placement of order indicates your acceptance of these terms and conditions. Please print out a copy for your records or contact Green Training Works Ltd.
Permitted Use / Restrictions
Green Training Works Ltd will supply products to customers for them to use for education and training purposes for their officers, employees and contractors. Where the customer is a consultant, the programmes may be used for education and training purposes for the consultant's clients, on condition that the products remain in the possession and under the control of the consultant at all times.
The products may only be used in their complete form, as supplied, without any editing or alteration to the audio or visual content, UNLESS STATED ON THE PRODUCT or agreed in advance with Green Training Works Ltd.
Permitted use of the products at the advertised prices is for use on a single video or computer screen at any one time. The customer shall not disseminate a product by satellite, terrestrial or cable broadcast or by network or electronic transmission without advance written agreement of terms and payment with Green Training Works Ltd. Where a customer wishes to use a product on an internal intranet, a licence agreement may be prepared for an agreed fee, based on the size of organisation and number of users.
Copying is illegal
Customers are not allowed to copy or duplicate any Green Training Works Ltd material without advance written agreement with Green Training Works Ltd or UNLESS STATED ON OR WITHIN THE PRODUCT.
The products are the copyright of Green Training Works Ltd and are protected by law. The customer is not allowed to:
1. Copy or duplicate a product in whole or in part (except where a CD-ROM format requires the product to be installed on the customer's equipment)
2. Edit or amend or add to a product or incorporate it within other material unless agreed in advance in writing with Green Training Works Ltd.
3. Sell, rent, lend or sub-license a product unless agreed in advance with Green Training Works Ltd.
4. Authorised user licences are available from Green Training Works Ltd for the reproduction of specific PowerPoint products when customised for third party training. Contact Green Training Works for details and application forms.
The customer will pay Green Training Works Ltd the price advertised at the time of placing the order. Prices are displayed on our website www.greentrainingworks.co.uk or in printed direct mail promotions. Current prices can be confirmed by telephoning Green Training Works Ltd. An invoice will be supplied for all products ordered, clearly showing the due price of each item. VAT is due on all UK orders unless the product is exempt or zero-rated. Delivery charges within the UK (at Royal Mail 2nd class or parcel rate) are included in the price. If a special service or express delivery is required, the additional costs may be charged to the customer.
Green Training Works Ltd reserves the right to refuse credit. Where credit is given, payment is due strictly 30 days from the date of invoice. Green Training Works Ltd has the right to charge interest at the rate of 1.5 per cent per month for any day beyond 30 days for which payment has not been received. All products remain the property of Green Training Works Ltd until payment in full has been received.
Unless otherwise stated it is our committed intention to supply products from our catalogue within 7 working days of receipt of order. The customer will be notified immediately if any delays are anticipated. Whenever possible, orders are despatched within 24 hours of receipt of order. If the goods have not been received within 7 working days of the expected receipt of goods date, it is recommended that customers contact Green Training Works Ltd by phone or e-mail to confirm
a) that the order was received
b) when the order was despatched
c) by which service the order was despatched and expected due delivery date.
Depending on the size of the order, most products are despatched by Royal Mail 2nd class or parcel post or by Business Post 3-day service.
Every effort will be made to fulfil orders required for a specific deadline. Where necessary, delivery arrangements will be discussed with the customer to ensure that these will meet their requirements.
Cancellation, Returns and Refunds
Green Training Works Ltd. guarantee to replace any video cassette, CD or DVD which is found to be faulty or becomes damaged during its lifetime.
Cancellation - It should be noted that once an order is received, Green Training Works Ltd accept this as an agreement to supply products. Once Green Training Works Ltd has accepted an order, the customer has no right to reject the goods. However any faulty or damaged videos, CDs or DVDs will be replaced (see Returns below). Green Training Works Ltd cannot accept responsibility for incorrect orders placed by a customer, although it may be possible to exchange products. Once the goods have been despatched to the customer, it becomes the customer's responsibility to ensure their safe return, in unmarked, re-saleable condition, within one working week, at the expense of the customer.
Returns - if a fault or damage is identified, the customer should notify Green Training Works Ltd by phone or e-mail as soon as possible. The customer will then be asked to confirm the problem in writing and return the faulty item to Green Training Works Ltd at the expense of the customer.
Once the faulty item is received, Green Training Works Ltd will despatch a replacement product at no additional cost.
As technology is changing rapidly, it is the customer's responsibility to ensure that the items ordered are compatible with the equipment in which it is intended they will be used.
Customers should contact Green Training Works Ltd if they believe that there are any circumstances, outside these Terms and Conditions, under which a refund is due.
Whilst great care is taken to ensure the accuracy of the content of our products, Green Training Works Ltd, the Producers and the Distributors disclaim any liability for loss, injury or damage arising from omissions, inaccuracies, application or interpretation of the products.
Environmental and Health and Safety Law is changing rapidly and we advise contacting the relevant authority (e.g. Environment Agency, SEPA, NIEA, HSE etc.) if you are unsure of your legal position.
Green Training Works Ltd cannot be held responsible for damage to video cassette players, CD or DVD players, computers or playback equipment of any kind, through incorrect handling, mis-use by customers or incompatibility between equipment and products supplied, malicious coding or any unforeseen human or technical forces.
